Engagement and Advocacy

The attorney-client relationship is established by a written engagement agreement, which describes the scope of representation, applicable fees, responsibilities, and the subject matter of the legal service. In defined urgent and special circumstances, agency can be created by conduct or oral understandings if confirmed in writing as soon as practicable. The client must provide full and accurate information for effective representation.

Özer Law Office may decline to represent clients where conflicts of interest or ethical issues arise or where the matter is beyond the competence or jurisdiction of the firm. All legal advice and services are rendered pursuant to, and in compliance with, the laws of the State of California, United States of America and rules governing attorneys.

Charges and Fees

The fees charged by Özer Law Office must be settled through mutual agreement between the lawyer and the client. Typically, a fee agreement or contract is signed indicating services to be performed, the extent of work involved, and a mutually agreed fee to be paid. In the absence of a specific fee contract, the relevant statutory provisions and minimum attorney fee tariffs apply.

  • The agreed fee generally includes all actions that must be taken for the conclusion of the matter, unless otherwise agreed.
  • Expenses arising from litigation, such as court fees, notification and postal charges, expert fees, travel and other accommodation costs, are in addition to the lawyers’ fee and are to be borne by the client.
  • The lawyers’ fees for services provided are charged by and due to law according to legal obligation, irrespective of whether or not a case is won.
  • In circumstances where the client terminates the lawyers’ mandate before completion of the engagement, or if the case is lost, fees already paid are non-refundable.
  • Clients seeking specific fee arrangements or payment schedules are invited to contact the office directly by telephone ((984) 614-4296) or e-mail ([email protected]).

All payments must be made in a timely manner according to the terms of agreement. Lack of payment in respect of fees and/or costs could result in a suspension or cancellation of legal service.

Client Liabilities

Clients of Özer Law Office are required to:

  • Provide truthful, complete and timely information and documentation related to their case;
  • Cooperate with and follow the instructions of the attorneys, including but not limited to timely providing requested information and attending all meetings, hearings, or other appearances;

  • Pay all invoices timely as well as all fees, costs and expenses as detailed in the agreement of engagement; and
  • Immediately inform the office of any change in the address or telephone number of such individual or any other change in the individual’s circumstances or matter.

Failure by a client to comply with these requirements may limit the scope of the attorneys’ representation of the client or be grounds to withdraw from representation.
